They have no rights to arrest and detain her like this. It
is against the law to arrest and detain without her breaking
the law and without the permission of the court. They are
arresting and detaining her to limit her freedom.
I don’t know whether she is being detained by the authority
with Act 10a. If she is being detained with that, they have
the rights to arrest her under the current military rule.
Forget whether it is good and right or not. According to that
act, she is being detained in accordance with the law. The
current Burmese law allow the authority to detain her without
the right to see her lawyers. The law are not in accordance
with the international law. They are designed to limit individual
freedom. The law are designed to arrest people without charge
and the direction of the court.
The house arrests of top NLD leaders are also detentions
in many respects. They cannot move freely. These are detentions.
There is no legal term [in Burmese] for the word ‘house
arrest’.
There is no proper enquiry into the Dipeyin incident by the
police yet. Legally, there must be proper inquest when someone
dies. Judges have to do it with the help from the police.
We still haven’t heard that they have done it. It could
be said that the failure to do so is not in accordance with
the laws.
