Postponement notice on protest against TIAA-CREF

On the Nov. 5, 2003 action announcement was released by Burma Point office; subjected “UNOCAL benefits from forced labor in Burma”. We have received TIAA-CREF’s, who invests in UNOCAL, announcement on their meeting being postponed until December 15, 2003 as says below. Please see attachment for details. Therefore, we would like to thank everyone for your interest in this action and request at once that to please continue to support the action in the future. We will be sending out a new action announcement before Dec. 15, 2003. Again, thank you all for your attention on this matter.

CREF Annual Meeting Date Changed

The College Retirement Equities Fund (CREF) Annual Meeting has been postponed from November 13, 2003 at 10:00 a.m. to December 15, 2003 at 10 a.m. The Board of Trustees has taken this action because a significant number of CREF participants did not receive proxy materials within the allotted time.

Due to a processing error discovered November 4, 2003, a significant number of CREF participants did not receive their proxy materials within the required notice period for conducting the CREF annual meeting. Unfortunately, because the error was discovered just yesterday, there is not time to give proper notice to the remaining participants and still hold the meeting on November 13.

To allow for meaningful shareholder participation, New York law and CREF’s corporate governance policies require notification of participants at least 10 days, and not more than 50 days, prior to the annual meeting, and a record date of no more than 50 days prior to the meeting.

The Board of Trustees has set October 31, 2003, as the record date for determining the number of votes entitled to be cast. Because a new record date is being set, all CREF participants will receive a new proxy statement and ballot and will need to vote their proxy again using the new proxy materials.

New proxy materials will be mailed to all CREF participants on or about November 13, 2003. The Board believes this course of action will afford all participants the opportunity to have their votes recorded in a timely and well-informed manner.
